Redevelopment Agency Agenda Item No. 05

Subject/Title: Joint Public Hearing on the Proposed Amendments to the Merged Brentwood and North Brentwood Redevelopment Plans Request Continuance to June 17, 2002 at 7:00 p.m.

Due to lack of quorum (lack of minimum number of eligible voting members), staff recommends that the two eligible members of the Agency take an action to continue the joint public hearing to Monday, June 17, 2002 at 7:00 p.m. The joint public hearing for June 11, 2002, will not be opened and no testimony or evidence for or against the Proposed Amendment will be heard, due to the lack of quorum.

A joint public hearing notice on the Proposed Amendment was published in the newspaper on May 15, May 22, May 29 and June 5. On May 13, notices of the joint public hearing were mailed to Brentwood and North Brentwood Project Areas’ property owners, residents and business, and to all taxing entities.

As of this writing, no written comments have been received for or against the Proposed Amendment from taxing entities or citizens. Redevelopment staff received phone calls from and held personal meetings with individual property owners regarding the Proposed Amendment. Answers and information provided by staff to the property owners during these discussions satisfied their concerns. 

Pursuant to Gov. Code §54955.1, any hearing being held or noticed by a local agency may by order or notice of continuance be continued to any subsequent meeting of the legislative body if it complies with adjournment procedures as stated in Gov. Code §54955. Government Code Section 54955 permits when less than a quorum exists, as in the present situation concerning the proposed amendments to the merged redevelopment agency plans, to take action to adjourn (or in this case continue the matter) from time to time.

If the eligible members pass this action, the Agency Secretary will take action to comply with the notice requirements set forth in Gov. Code §54954.2.
