| CITY COUNCIL AGENDA ITEM NO. 20 Meeting Date: August 27, 2002 Subject/Title: Amending an Ordinance Sections 10.13.210 and 10.13.220 of the Brentwood Municipal Code concerning stopping, standing, and parking. Beougher Approved by: John Stevenson, City Manager RECOMMENDATION Amending Ordinance Sections 10.13.210 and 10.13.220 of the Brentwood Municipal Code concerning stopping, standing, and parking and authorize the City Engineer to determine the appropriate time limits for vehicle parking for a period of time no longer than the notice, curb marking or sign state. PREVIOUS ACTION On February 10, 1998, the City Council adopted Title 10 of the Brentwood Municipal Code Ordinance No. 592 pertaining to vehicular parking. BACKGROUND The City Council has had previous discussions regarding inadequate downtown parking. The residents and business owners have requested on numerous occasions for staff to find a solution. After analyzing and walking the downtown area, staff noticed that during school hours, Liberty High School students use a considerable amount of the parking. As high school attendance increases, so does the number of student vehicles utilizing public parking. To improve this parking issue, the City and the School District shared construction cost and expanded the Liberty High School parking lot from 188 spaces to 345 spaces. The construction for this parking lot has been completed, and City staff has installed proper signs to restrict the parking in the downtown area. However, high school students are still parking their vehicles in public spaces intended primarily for non-student use. Staff’s recommendation for solving this problem is to amend the parking ordinance and then enforce it appropriately. The attached Exhibit “A” depicts the locations and associated time limits for new parking restricted areas based on the proposed amendment to the Ordinance. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AMENDING SECTIONS 10.13.210 and 10.13.220 OF THE BRENTWOOD MUNICIPAL CODE CONCERNING STOPPING, STANDING, AND PARKING WHEREAS, the City Council has established certain parking restrictions and has found the need to implement new vehicle parking time limits for various areas of the City; and WHEREAS, the City Council now intends to authorize the City Engineer to determine appropriate time limits for vehicle parking for a period of time no longer than the notice, curb marking, or sign state. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, as follows: Section 1. The foregoing recitals are true and correct, and this City Council so finds and determines. Section2. Section 10.13.210 shall be amended to read as follows: “10.13.210 Forty -five minute and one-hour parking areas. When authorized signs, notices, or curb markings have been determined by the City Engineer to be necessary and are in place giving notice thereof, no operator of any vehicle shall stop, stand, or park such vehicle during the hours and days designated, except by permit in accordance with Section 10.13.280, for a period of time longer than forty five minutes or one hour as the adjacent signs, notice, or curb markings indicate.” Section 3. Section 10.12.220 shall be amended to read as follows: “10.13.220 Authorized Parking. When authorized signs, written notices, or curb markings have been determined by the City Engineer to be necessary and are in place giving notice thereof, no operator of any vehicle shall stop, stand, or park such vehicle during the hours and days for the time limit designated by such notice, except by permit in accordance with Section 10.13.280, for a period of time longer than the signs, written notices, or curb markings state. “ Section 1. This resolution shall take effect immediately upon its passage.
