RIGHT TO FARM DISCLOSURE

The City of Brentwood has declared its policy to protect and encourage agricultural operations in its General Plan and has adopted a “Right to Farm Ordinance”. If your property is located in the City, near an agricultural operation, you may at times be subject to inconvenience or discomfort arising from those operations, including noise, odors, fumes, dust, smoke, insects, the operation of machinery (including aircraft) during any time of day or night, the storage and disposal of manure, and the ground or aerial application of fertilizers, soil amendments, seed, herbicides, and pesticides.  These and other similar inconveniences will not be considered a public nuisance if they are conducted according to proper and accepted customs and standards.  The Right to Farm Ordinance establishes a grievance procedure to help resolve any disputes between agricultural operators and their neighbors.  This is only a summary of the Right to Farm Ordinance.  If you wish further information about the meaning or effect of the ordinance or the grievance procedure set forth in it, please contact the City’s Community Development Department at 150 City Park Way, Brentwood, CA 94513 or call (925) 516-5405.

AND AVAILABILITY OF A NEGATIVE DECLARATION

Notice is hereby given that the Planning Commission of the City of Brentwood will, at 7:00 p.m. or as soon thereafter as the normal course of business permits on May 7, 2013, hold a public hearing to consider the following application:

A resolution of the Planning Commission of the City of Brentwood recommending adoption of the Negative Declaration and finding that the proposed 2013/14 – 2017/18 Capital Improvement Program (CIP) Budget is consistent with the adopted General Plan and specific plans of the City of Brentwood as required by sections 65401 and 65402 of the Government Code.

A Negative Declaration has been prepared pursuant to the California Environmental Quality Act, to assess potential environmental impacts.  The range of projects listed in the CIP include:  improvements to roadways; parks and trails; water and wastewater systems; community facilities; and development-financed improvements.

Project sites are not on any of the list of sites enumerated under Section 65962.5 of the Government Code as related to hazardous materials.

The draft Negative Declaration, initial study and copy of the CIP Budget are available for public review and comment for thirty (30) days beginning on March 29, 2013, and ending on April 29, 2013.  The draft Negative Declaration is available for review at the City of Brentwood Community Development Department, 150 City Park Way.

1)   Eliminating the requirement for new residential rental development to comply with the Ordinance, consistent with the Palmer/Sixth Street Properties LP v. City of Los Angeles case.
2)   Applying the requirements of the Ordinance to subdivisions of 25 or more dwelling units/lots.
3)   Allowing the payment of a Low Income level In-Lieu Fee for developments between 25 and 74 dwelling units.
4)   Allowing payment of In-Lieu Fees at the time of building permit issuance of Market-Rate Units.
5)   Allowing the Finance Director to utilize Housing Funds towards the City Council-approved Housing Division operating budget.
6)   Removing the Moderate Income requirement of the Ordinance, changing it to Zero.
7)   Reducing the overall obligation of the Ordinance to 2%.
8)   Keeping the alternatives that are currently in place.
9)   Adding the In-Lieu Fee methodology of the Market-Rate Median 12-month Sales and basing it on a 3 bedroom 2 bath model, or using the new-construction cost based In-Lieu Fee, whichever is lowest.
