California Assembly Bill 253 is designed to help speed up permits for small to medium-sized housing projects. It applies to residential developments with 1 to 10 units, including duplexes, small apartment buildings, ADUs accessory dwelling units, remodels, and additions, as long as no occupied floor is more than 40 feet above ground.
Plan check is the process of reviewing construction plans before a building permit is issued. This review often happens in stages: the City reviews the plans, provides comments or corrections if needed, and the applicant resubmits updated plans for another round of review.
Under AB 253, If the City states that a review round will take longer than 30 business days, or if the City does not complete that review round within the 30-business-day period, the applicant may hire a qualified private plan checker. The private plan checker reviews the plans for code compliance and submits an official report to the city.
Once the city receives that report, it has 10 business days to either issue the permit or request corrections. If the city does not respond within those 10 business days, and the private plan checker confirms that the plans comply, the permit is automatically deemed approved. AB 253 aims to create a faster and more predictable process for small residential housing projects.
